Welcome to Scorecare Team!
The Terms and Conditions operate as a binding and
enforceable legal contract between (SCORESATHI TECHNOLOGIES PRIVATE LIMITED PRIVATE LIMITED) and the
user of Scorecare Team. By downloading, accessing, or using SCORECARE mobile application / website, you agree to be
legally bound by these Terms & Conditions. If you do not agree, please
discontinue use of the app / website / uninstall the Application.
SCORECARE App operated
by SCORESATHI TECHNOLOGIES PRIVATE LIMITED PRIVATE LIMITED
at present having registered office at the address P.No.18/2 , Sector III, HUDA TECHNO ENCLAVE,
Madhapur, Shaikpet, Hyderabad- 500081, Telangana is a service provider that focuses
on developing and delivering digital business solutions. Scorecare is a credit information
and credit-health platform that helps individuals access, understand, and
improve their creditworthiness, alongside related financial convenience and
facilitation services. The business provides the services including but not
limited to credit score services, credit improvement plan, credit report
services, credit repair services, bill payment services, bill collection
services and intermediary services for loans and credit cards.
The
platform is operated through a mobile application / website and seeks to deliver
business solutions to users based on their subscription packages. The
installation and use by the user of the SCORECARE
mobile Application / website / platform is bound by the certain terms
and conditions which are listed below. The said terms & conditions
mentioned below is a legally binding and enforceable contract between SCORECARE and users. You (users) agree
that by availing the services through website / mobile application /platform and
by enrolling in the services offered by SCORECARE,
the users are voluntarily accepting to be bound by the below terms and
conditions.
The
website /mobile Application / platform is originally created by or on behalf of
SCORESATHI TECHNOLOGIES PRIVATE LIMITED Private Limited and
is owned and operated by them. Please read the below terms & conditions
before enrolling in the services offered by SCORECARE. As remarked above, availing of services offered by SCORECARE is voluntary and access /
downloading of the app / website shall be deemed as acceptance of the terms and
conditions mentioned herein.
SCORECARE reserves and is entitled to
change or modify these Terms & Conditions / Privacy Policy or any other
policy or guideline of the Website /mobile Application / platform at any time
and in its sole discretion. Any change in these Terms & Conditions /
Privacy Policy or any other policy or guideline will be effective immediately
upon posting the revisions on the Website /mobile Application / platform. The
continued use of the Website /mobile Application / platform will confirm the
users acceptance of such changes or modifications.
The
below mentioned Terms and Conditions are in accordance with the provisions of
Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules,
2011.
Registration Process
The user
would be able to avail services only upon registration by providing correct
verification details. The user undertakes to provide with accurate information
such as name, address & phone number, geographical location, email id, PAN
Details, date of birth. The user agrees that they are of an age which makes them
eligible to enter into valid contracts under the Indian Contracts Act, 1872. The
user agrees that SCORECARE will
not be liable for any incorrect information provided by them. The user undertakes to notify and inform SCORECARE of any change in the
information provided. The user acknowledges that SCORECARE has not verified the
information provided by the user and as such the user solely responsible for
any such misrepresentation. The user also
undertakes and agrees that SCORECARE
shall not be liable in any manner for the
illegality or misrepresentation of any information that has been provided by the
user. If in future at any time SCORECARE
finds that the information provided by the
user is inaccurate or fabricated, SCORECARE has
the right to disable the said account with immediate effect.
The user also agrees to provide a consent form to permit SCORECARE to access
credit/debit card details, photograph, signature, bank account details and KYC
documents (Know Your Customer) like the PAN and Aadhar Card and credit scores.
The user
agrees that SCORECARE has the right
to terminate or restrict access to the website or suspend the user at any time
without according any reasons for doing so.
Representation by the User
To
access the services provided by SCORECARE,
the user must create an Account by completing the registration process.
By
registering to avail the services the user represents that:
(a)
The user is of 18 years of age and;
(b)The
information which is provided is true and that the user had not misrepresented
any information.
The user
expressly agrees and undertakes that SCORECARE
at any time can suspend or terminate the account and refuse any and all
current or further use of the Platform and all its services if it is determined
or have reason to believe that any information provided by the user is untrue
or inaccurate. Please note that it is the user’s responsibility to keep the
user name and password safe. SCORECARE shall
not be responsible for unauthorized access to or alteration of the data. It is
agreed that the username and password are personal and under no circumstances
may the user allow any other person to use the username and/or password. SCORECARE shall not be liable for any
harm caused or related to the theft or misappropriation of any users personal
as well as business details, including username and/or password, disclosure of
username and/or password, or authorization of anyone else to use the username
and/or password. The users are responsible for all the legal information
provided for the registration of their accounts on SCORECARE.
The user
agrees that SCORECARE does not
have any responsibility or liability in respect of any communication between the
user and any third party websites visited by the user through SCORECARE.
Information Collected automatically:
Users understand and agree that while using
Scorecare, the following information is collected automatically:
a. Device Information and Activity Data- Actions that
is integral to the Platform and interactions with other platforms like
reblogging. While not revealing the specific identity, but may include device,
activity and usage information, such as your IP/ MAC address, browser and
device characteristics, operating system, language preferences, referring URLs,
time-spent, device name, country, location, information about how and when the
users avail SCORECARE’s Services and other technical information. The said
information is collected purely for security purposes to ensure the users do
not misuse the platform for illegal or unlawful activities.
b. User log data: SCORECARE stores data relating to
login information, the details of last login, the IP addresses from which the
login has occurred and relevant related information.
Purpose of collecting Information:
The information so collected by SCORECARE is used to
successfully provide and improve the services rendered by SCORECARE, maintain a
secure environment, and the statistics help SCORECARE to assess usage and
effectiveness in improving the performance of the Platforms. The information is
also necessary to perform internal compliance, fix operational issues, improve
performance and analyze usage trends.
The information shall also be used and processed for
the following purposes
a. Conduct a KYC Check and background verification of
the credentials provided by the users as per Applicable Law
b. Assist business partners and other involved third
parties to render the relevant services to the users like processing payments,
services and promotional offers
c. Help users to resolve their queries while using SCORECARE’s
services
d. Provide information to the users about any
promotional offers, discounts, new initiatives and administer any obligations
arising out of this Agreement
e. Providing personalized content about offers and
location based services.
f. Assist SCORECARE to protect itself from fraud or
abuses of the website or to enable third parties to carry out logistical or
other functions on SCORECARE’s behalf.
g. Send notices to the users, communications, update
the users records, and notify the users about any suspicious security breaches
or unusual activity on the account.
h. Act on the users’ behalf and engage with their
lending partners to facilitate loan-related actions, including repayments,
closures, and settlements.
i. Contact the users’ lending partners and share
relevant personal, financial, and loan related information, as necessary, to
carry out the above actions based on their request.
Use of
cookies:
Users understand and agree that SCORECARE avails the
help of cookies, web beacons when the user accesses the platform. While the
users have the option to remove the cookies or opt out of the same, there is a
possibility that they may not be able to experience the full potential of the
services rendered by SCORECARE. Web beacons cannot be declined by the users but
may be rendered ineffective declining all cookies or by modifying the users’
Apps’ web browser settings to notify the user each time a cookie is tendered,
permitting them to accept or decline cookies on an individual basis.
SCORECARE may use third-party software to serve ads
on the Platform, implement email marketing campaigns, and manage other
interactive marketing initiatives. This third-party software may use cookies or
similar tracking technology to help manage and optimize the users online
experience. It is therefore, the users’ responsibility to disable cookies if
required on each of such third party platforms they have access to.
Responsibilities of the Users
The user
understands and undertakes that

SCORECARE collects
personal information- including the ones provided voluntarily by the users and
the ones that are collected by them via cookies, while users visit the website.
·
The user understands that SCORECARE uses third parties to provide
services and merely acts as a facilitator between the two parties.
·
For the purpose of generating the users’ credit
score and retrieving the credit report, SCORECARE
has partnered with Surepass Technologies, a verification and data-services
provider that is integrated with authorized Credit Information Companies (CICs)
such as Experian, Equifax, and CRIF High Mark.
·
By giving consent, the users authorize SCORECARE to share your PAN, mobile
number, email ID, and date of birth with Surepass, solely for the purpose of
verifying your identity and retrieving your credit score and credit report from
the relevant credit bureau(s) on your behalf. Surepass acts as a
technology/processing intermediary in this flow and is contractually bound to
use your information only for this stated purpose, and not for any unrelated
use.

The users understand that the details so collected
are not for marketing purposes but purely for credit bureaus, lending partners,
and applicable regulations require to authenticate users and deliver the
specific service they have requested, whether that’s pulling users’ credit
data, processing a bill payment, or routing a loan/card application.
·
If the user visits any third-party website or
any affiliated links from SCORECARE website/mobile
Application, they are governed by the terms and conditions and privacy policy
of such third party website and any act or omission done by the users while
accessing those websites are not binding upon SCORECARE.
·
The services provided by SCORECARE are based on the information
submitted by the users and SCORECARE is
not liable for any misinformation of the users so provided.
·
The users understand
that the data so collected by SCORECARE shall not be disclosed to any third
party in excess of what is necessary and needed for legal compliance with the
law of the land.
·
The users shall comply with all necessary laws,
wherever applicable.
·
The user undertakes not to use the
website / mobile Application / platform or any material for any purpose other than what is
specifically mentioned herein. The user
further undertakes not to commit anything that is unlawful, illegal or prohibited
or other activity which infringes the rights / Intellectual Property Right of SCORECARE / third party websites or other third parties;
Credit Improvement Plan & Disclaimer
Scorecare provides credit analysis,
credit education, dispute assistance, and credit improvement guidance based on
the information provided by the customer and data received from credit bureaus
and other sources.
The
Customer acknowledges and agrees that:

Scorecare
does not guarantee any specific increase in credit score, credit rating, loan
approval, credit card approval, or removal of negative information from any
credit bureau report.
·
The Credit score improvement depends on
multiple factors, including but not limited to the customer’s credit history,
repayment behavior, existing liabilities, bureau records, lender reporting
practices, and the accuracy of information available with credit bureaus.
·
Any estimated improvement timeline, projected
score range, or expected outcome shared by Scorecare
is for informational purposes only and should not be considered a guarantee or
commitment.
·
Credit improvement services may take between 60
to 90 days or longer depending on the complexity of the case and responses
received from credit bureaus, banks, NBFCs, or other financial institutions.
·
Scorecare
shall not be held liable for any delay, rejection, non-improvement, partial
improvement, or adverse outcome resulting from factors beyond its control.
·
The Customer understands that final decisions
regarding credit score calculation, dispute resolution, loan approval, and
credit card approval rest solely with the respective credit bureaus and
financial institutions.
By using
Scorecare’s services, the
Customer expressly acknowledges and accepts that credit improvement is not
guaranteed and that results may vary from person to person.
Confidentiality and User Personal Data.
When the
user avails any service, SCORECARE will
be notified of the details of the users not limited to name, location, address,
PAN details, KYC details and phone number. The user agrees that user
information or any other information relating to use of the services may
contain confidential and personal information.
The user agrees and undertakes that such information will remain the
sole property of SCORECARE and will
be shared with third parties to aid in rendering of the services as mentioned
above.
The user
acknowledges and agrees that in very rare instances, security protocols could
fail, causing a breach of privacy causing data breach including card details, user’s
personal information and the like. SCORECARE
shall take utmost care towards protecting the users confidential and
sensitive information from reaching the hands of unscrupulous third parties.
In the
unfortunate event of any content of the website / platform is defamatory,
obscene, pornographic illegal or blasphemous, racist or harassing, kindly
notify SCORECARE immediately. SCORECARE shall take reasonable
endeavors to take down the objectionable content within a reasonable time.
Fee
& Payment
The services rendered
by Scorecare are rendered as subscription cycles. The fee to be paid for each
subscription cycles is as follows:
Payment cycle-Table
The users understand
that the services shall commence only after full payment of the subscription
amount.
Return
& Refund
Subscription fees
paid for any billing cycle are strictly non-refundable. Scorecare does not
offer partial or prorated refunds for any unused portion of subscription periods.
Customers may cancel
their subscription at any time during their active subscription period.
Following cancellation, the subscription remains active until the conclusion of
the current billing cycle, after which no further charges will apply unless the
customer chooses to renew their subscription.
In cases where a bill
payment transaction fails after funds have been debited from your account, the
amount will be automatically refunded to your original payment method. The
refund timeframe depends on the payment channel and the banking partners
involved. Transactions that have been successfully initiated and processed
cannot be canceled, as the funds are immediately forwarded to the intended
service provider. If a payment is made in error, duplicated, or disputed,
please contact the relevant service provider directly. Scorecare will offer
necessary assistance to facilitate communication and help resolve such issues.
Returns shall not be entertained for any other
purposes except as expressly laid down in the Terms and Conditions.
Intellectual Property
The user undertakes that using the
Services does not give them ownership of any intellectual property rights in the
Services or the contents they access. The Contents of the Application / website
/ platform and all other intellectual properties used in the platform are owned
by THE SCORECARE. The Trade Marks and all other intellectual properties belong to SCORECARE. By allowing
access to the user or any third party does not convey any ownership rights of
the platform. The user shall not
copy, modify, translate, distribute, reproduce or reverse engineer any content
of the platform.
Indemnification
The user agrees to
defend, indemnify and hold harmless SCORECARE and any of their respective
officers, Executives, directors, employees, agents and representatives from any
and all claims arising out of the users’ breach of any of these terms and
conditions. The indemnification obligation under these Terms & Conditions
will survive the termination of the account or use of the Platform. The
user agrees not to copy, modify, reverse engineer, decompile,
disassemble, create derivative works of the Software nor attempt to locate or
obtain its source code.
The user
agrees that at certain times technology Platforms are susceptible for glitches
and issues and hence, as a result if any transaction/trade order / payment
doesn’t get processed, as expected, SCORECARE
cannot be held responsible.
Further,
the user agrees to hold SCORECARE
harmless against any claims made by any third party due the use of the platform,
any claim that the users material caused damage to a third party, the users’
violation of the Terms, or the users’ violation of any rights of another,
including any intellectual property rights.
Warranty and liabilities:
The user agrees and undertakes that the platform does
not provide any warranty implied or otherwise. To the maximum extent permitted
by Law, SCORECARE shall not have any liability whatsoever in respect of any
transactions carried on between the users and third-party websites the users
access as external links. SCORECARE also disclaims any liability in respect of
misuse, loss, modification or unavailability of any user content. The
user understands and agrees that any
data downloaded obtained through the platform, is done entirely at their own
discretion and risk and they will be solely responsible for any damage to their
computer systems or loss of data that results from the download of such
material or data.
The parties agree and understand that SCORECARE shall
not be responsible for any indirect or inconsequential damages.
Any complaints or concerns and reviews raised by the
users relating to the services provided shall be addressed at the earliest
provided they are reported within 24 hours of completion of the service
request. Due process would be followed and the remedies include full or partial
refund of the subscription amount and assistance with the relevant banking
authority.
Damages
The user
agrees that any infringement or any violation of
these Terms and Conditions will cause irreparable loss and damage to SCORECARE and
as such will constitute an unlawful and unfair business practice for which
damages in monetary form would be inadequate. As a result, the user agrees and undertakes and provides rights to SCORECARE to
obtain any injunctive or equitable relief that they deem necessary or
appropriate in such circumstances. These remedies are in addition to any other
remedies that SCORECARE may have at law or in equity. If any legal action against the
user as a result of the violation of these Terms and Conditions, SCORECARE is
entitled to recover from the user and in addition the user shall be liable to
pay all reasonable attorneys’ fees and costs of such action, in addition to any
other relief that may be granted.
Termination
These Terms and conditions will
commence on the date when the user registers on the platform of SCORECARE. The same
shall continue to subsist until the termination of this agreement by both the
parties.
These
Terms and conditions will apply until terminated by either of the parties. In case the user wishes to terminate this
arrangement, the user may not visit the platform or close all the services
where available to do so. The user agrees that SCORECARE is at free will to terminate the users account in the
event of any breach of the terms of this Privacy Policy, or the services
previously provided are no longer available. SCORECARE is also at liberty to suspend or terminate the accounts
in the event of misuse, fraud, misrepresentation or a violation of the Terms
and Conditions and Privacy Policy.
Amendments:
The user
agrees that SCORECARE can at any time have the right
to modify or amend these Terms and conditions without any requirement to notify
the user of the same. The last updated ‘terms and conditions’ shall always be
updated in the platform along with the last
updated date. The user shall be responsible to
check if there is any update to the said Terms and Conditions. The users’ acceptance of the amended Terms and Conditions shall
signify consent to such changes and agreement to be legally bound by the same.
Severability
If it
turns out that a particular term is not enforceable, this will not affect any
other terms.
Notices
Notices or letters or any communication shall be sent to the
registered email id on the platform. Sending of an email to the correct email
address shall have the same effect and rights as a physical notice. It shall be
the users responsibility to check emails.
Force Majeure:
Failure to do any act or duty shall
not constitute default hereunder if and to the extent caused by force majeure,
which is defined to be occurrences beyond the reasonable control of such party
committing default, including and limited to acts of the government
authorities, acts of God, fire, flood, explosion, riots, war, labour strikes,
sabotage, rebellion, insurrection, epidemic, pandemics or similar outbreak.
However, the user has to immediately notify such reason to SCORECARE at the
earliest. Failure to notify of the same would result in suspension /
termination or any other action as deemed fit.
Remedies
The User agrees and acknowledge
that damages in the form of monetary compensation may be an inadequate remedy
for breach or threatened breach of the provisions of these Terms and Conditions
and as a result user agrees that in the
event of a breach of any provisions of these Terms and Conditions by the user,
the rights of SCORECARE in addition to any and all other rights and remedies that may be
available to SCORECARE in respect of such breach, shall be enforceable by specific
performance, injunctive remedy or any other remedy available in any court of
competent jurisdiction.
Jurisdiction
Any dispute arising out of this
terms & conditions shall be exclusively filed at the Court at Hyderabad,
Telangana, India.
Applicable Law
The Applicable Law in relation to
any dispute arising will be the Laws of India.
Arbitration
In
the event of any dispute between the parties arising out of or in relation to
this terms and conditions, the same shall be referred to an Independent Arbitrator
which has the exclusive jurisdiction to resolve the dispute. The arbitration
will be governed by laws of India at the time being in force. The arbitration proceedings shall be
constructed in English language and shall take place in the city of Hyderabad. The
fee of the Arbitrator shall be equally borne by the parties.
